The quickest way to get divorced can be simple. A fast search on Google and you may be asking yourself, “Can I be divorced quickly and sipping Mai Thai’s in a year?”
The short answer is yes!
A “quick divorce” can also be known as an uncontested divorce. This is when you and your ex agree to divorce. This is much different from a contested divorce, which is when you and your ex do not agree to all the issues raised by the divorce. This could include disagreements about child custody and/or support, how you will divide your assets, custody over your pet or your 1965 Dodge Charger that is like another “baby”.
However, before you make an appointment with your lawyer, make sure of the following:
Once you have answered yes to these questions and received your marriage certificate, you can make an appointment with your lawyer.
Your lawyer will meet with you and obtain your full background of the relationship. Keep in mind, there are fees to a simple divorce, but these are much less costly when both parties can agree. If your ex is agreeable to the simple divorce and both of you are not contesting any assets and are in agreement, your lawyer will prepare an Application.
This Application, along with a blank Answer form, will be served upon your ex, and proof of service will be filed with the Court.
Next, your ex has thirty (30) days to respond from the day they were served (received the documents) to file an answer. If your ex agrees to everything in the Application, they do not have to file an Answer. Simply after thirty (30) days have passed, your lawyer will complete the next steps.
After the Court has received the necessary forms from your lawyer, and a Judge has reviewed all the forms and granted the divorce, they will send your Divorce Order in the mail, and your divorce will take effect on the 31st day, after, the Judge has signed the Order.
Once the 31 days have passed, you may ask your lawyer to obtain a Certificate of Divorce for you. You will need this certificate if you want to remarry in the future.
