If you and your ex-partner are mutually seeking a divorce, you may be eligible for an “uncontested” or, in other words, “quick divorce”. A quick divorce can be described as an efficient divorce procedure available to those who agree to a simple divorce process and do not have any external issues relating to the marriage. The first step to a quick divorce is filing the standard forms for an application for divorce. These forms are Form 8A: Application and Form 36: Affidavit for Divorce. The parties may wish to file in one of two ways: a sole divorce application, or a joint divorce application. For a sole divorce application, once the Application form is filed with the court, your ex-partner has 30 days to respond from the day they’ve been served with the issued Application via a third party. Your ex-partner, however, can agree with the contents of the Application or does not have to file a response or sign anything. After the 30 days have elapsed, the Applicant will file an Affidavit for Divorce for the court’s review and the Judge will make an Order finalizing the divorce. The divorce will be effective after 31 days of the court order. In a joint divorce application, the parties complete and file the forms together, which notifies the court that the parties intend to divorce. The joint application speeds up the process by eliminating the need to serve your spouse.
The parties will also need to file the original marriage certificate and registration of divorce proceedings. All divorce Applications must be filed at the Superior Court of Justice. The location of the courthouse will depend on the “habitual residence” of the parties who intend on getting the divorce.
